PEER VEET will ensure the Apprentice/Trainee has completed an ‘off job’ workplace employee induction program, and has been instructed in and is aware of their obligations in regard to Occupational Health, Safety and Welfare compliance.
The Apprentice/Trainee will be provided with a copy of PEER VEET’s Apprentice Information and Safety Manual for ongoing reference.
PEER VEET will supply each Apprentice/Trainee with safety clothing and equipment. These items which are in accordance with Australian Standard 2210, include trousers and shirts, “bluey jacket,” safety footwear, clear and tinted safety glasses, gloves, earplugs, dust mask, hard hat, sun hat, sun screen and safety bag to contain all such items.
In accordance with the relevant sections of the Occupational Health, Safety and Welfare Act and the Occupational Health, Safety and Welfare Regulations (as amended), the Host Employer shall as a minimum:

Provide and maintain a safe work environment, safe plant and substances and safe systems of work such that, so far as is reasonably practicable, PEER VEET Apprentices/Trainees are not exposed to hazards within their workplaces and are safe from injury and risks to their health;

Provide such information, instruction, and training to, and supervision of, PEER VEET Apprentices/Trainees as is reasonably necessary to ensure that they are not exposed to hazards and risks and do not create workplace hazards and risks for others.

Ensure, so far as is reasonably practicable that the use, handling, cleaning, maintaining, transporting, storage, processing and the disposal of plant, equipment and substances in the workplace are carried out in a manner such that PEER VEET Apprentices/Trainees are not exposed to hazards and risks in the workplace.
Occupational Health & Safety Agreement between PEER VEET and the Host Employer

For the purposes of the OHSW Act 1986, an Apprentice or Trainee, who is engaged by a Host Employer to perform work for the Host Employer, is deemed to be employed by the Host Employer. However, the Host Employer’s duties under this Act, in relation to them, extend only to matters over which the Host Employer has control or would have control but for some agreement to the contrary between the Host Employer and the Apprentice or Trainee or PEER VEET.

Accordingly, the Host Employer has specific responsibilities and obligations to the Apprentice or Trainee under the OHSW Act 1986. In particular the Host Employer has a Duty of Care to the Apprentice or Trainee as delineated by Section 19 of the OHSW Act 1986.

It should be acknowledged by the Host Employer that in the event of an injury to a PEER VEET Apprentice or Trainee, PEER VEET bears the Workers’ Compensation liability associated with this injury.
However, in the event of Host Employer negligence resulting in injury to a PEER VEET Apprentice/Trainee the Host Employer may be liable for breaches of the OHSW Act and Regulations, which may result in convictions and fines. Enforcement of the OHSW Act and Regulations is the responsibility of the SafeWork SA Inspectors (Dept of Administrative and Information Services) not PEER VEET.
It is a requirement of this agreement that the Host Employer will meet its obligations under the OHSW Act, the OHSW Regulations and any relevant approved Codes of Practice.
In particular it is a requirement of this agreement that the Host Employer will:

Do all things reasonably practicable to eliminate hazards and control risks to health and safety in the workplace;

Notify PEER VEET of any fundamental changes to the workplace, work practices or procedures, plant equipment, materials or substances that may put the health and safety of Apprentices or Trainees at risk;

Provide Apprentices or Trainees with appropriate supervision consistent with the risks to health and safety associated with the work performed;

Provide Apprentices or Trainees with appropriate information, instruction and training to enable them to safely carry out their job;

Provide evidence of and conduct a formal induction process, that includes OHSW, when the Apprentice or Trainee commences work with the Host Employer (also, individual site inductions may be required and need to vary dependant on the identified hazards and risks at each worksite).
It is also a requirement of this agreement that the Host Employer will:

Provide PEER VEET authorised staff with access to the worksite (when permissible) where PEER Apprentices or Trainees are performing work;

Support the right of PEER VEET to monitor the health and safety of Apprentices and Trainees whilst working with the Host Employer;

Accept representation, by PEER VEET Recruitment and Training Coordinators or PEER VEET nominated personnel, in relation to the health and safety of PEER VEET Apprentices or Trainees;

Verbally inform and provide a documented accident report to PEER VEET or their representative of any accidents, incidents or injury occurrences involving PEER VEET Apprentices or Trainees within 24 hours (where practicable);

In the event of a hazard being reported or an incident or injury occurring to a PEER VEET Apprentice or Trainee, permit PEER VEET personnel to conduct an investigation to determine contributing factors and remedial actions;

Liaise with PEER VEET personnel with respect to the implementation of appropriate control mechanisms in order to prevent a recurrence of incidents or injuries;

As soon as practicable report to PEER VEET, that they have notified the Department of Administrative and Information Services (Workplace Services), of any Dangerous Occurrences and/or Default, Improvement, or Prohibition Notices that have been issued to / placed on the Host Employer.
